  • I give all my real and personal estate and effects to my dear wife Mariana Aplin and her heirs etc for her own benefit.
  • If my wife dies in my lifetime I give all my plate, linen, china, books, prints, pictures, household furniture and household effects, and all my ready money, bonds, bills, notes, mortgages and other securities for money to my wife's niece Mariana, daughter of Colonel Haultain, for her own benefit.
  • I appoint my wife sole Executrix.
  • I give all estates which may be vested in me upon Trusts or by mortgage to my nephew Benjamin William Aplin of Banbury, gentleman, and his heirs etc, upon the relevant Trusts etc.
    The money secured by such mortgages is to be taken as part of my estate by my wife or niece.

I Benjamin Aplin late of Banbury in the County of Oxford but now residing at Leamington Priors in the County of Warwick Esquire do hereby revoke all former Wills and Testamentary dispositions made by me and do declare this to be my last Will and Testament I give devise and bequeath all my real and Personal Estate and Effects whatsoever and wheresoever and of whatever tenure or nature the same may be and of which I may die seized or possessed unto my dear wife Mariana Aplin her heirs executors administrators and assigns respectively for her own absolute use and benefit But in case my Wife shall die in my lifetime Then I give and bequeath all my plate linen china books prints pictures household furniture and household effects and all my ready money bonds bills notes mortgages and other securities for money to Mariana the daughter of Colonel Haultain and niece of my said Wife for her own absolute use and benefit And I appoint my said Wife sole Executrix of this my Will And Lastly I give devise and bequeath to my nephew Benjamin William Aplin of Banbury aforesaid Gentleman his heirs executors administrators and assigns all estates which may be at the time of my decease vested in me upon any trusts or by way of mortgage of which I have power to dispose by this my Will with their respective appurtenances But upon the Trusts and subject to the Equity of redemption which at the time of my decease shall be subsisting or capable of taking effect therein respectively and the money secured by such mortgages to be considered and taken as part of my Estate by my said Wife or niece as the case may be In Witness whereof I the said Benjamin Aplin the Testator have to this my Will set my hand this thirtieth day of January in the Year of our Lord one thousand eight hundred and forty seven B Aplin
