I give the following pecuniary legacies, all free of legacy duty: To my friend Annie Penny, wife of James Penny of 23 St John’s Rd Oxford, £10. To Frank Hudson Jenkins of Little Clarendon St Oxford, greengrocer, £3. To Louisa Kate Jenkins, daughter of George Jenkins greengrocer of 9 Little Clarendon St, £3. To Dorothy Walker, daughter of Charles Bolton of 2 Observatory St Oxford, £3. To Mary Ann Webb, daughter of the late James Webb saddler of Church Square Islip, £3. To Gertrude Mary Cook, wife of Frederick Cook of 14 Farndon Rd Oxford, £3. To Hannah Read, widow of Charles Read blacksmith of 29 Friars Wharf Oxford, £3. One Preference share and two Ordinary shares in the Oxford Gaslight and Coke Company. £100 of India 3% stock, part of my £200 of that stock. £400 of New Zealand 3½% stock I give my Executors all my furniture, jewellery, pictures and other chattels and effects, requesting that they will dispose of them in accordance with any memorandum left among my papers at my death, but such memorandum is not to have any legal force. I give my Trustees my leasehold messuage etc at 5 Avery Row New Bond St London, held under the Corporation of the City of London and in the occupation of Henry Brand and Son: Upon Trust: To permit my cousin John Andrew Bridgwater to occupy the premises or receive the rents etc for life, he paying a proportion of the ground rent, fire insurance, rates and taxes, and performing the covenants of the lease. After his death, to sell the property and divide the proceeds between those of his children who outlive me, and the children of any who predecease me and who reach age 21 or (if female) marry earlier, per stirpes, as tenants in common. (But subject to the proviso below re the share of Frederick Tyrrell Bridgwater). I give my freehold dwelling house etc called Painswick Cottage at 232 Banbury Rd Summertown Oxford, now in the occupation of William Hicks, to George Parsons Day, a son of my late cousin Thomas James Day (if he outlives me) and his heirs forever. I give my two freehold cottages in Church Square Islip, now in the occupations of Ernest Shirley and George Wastie, plus the small bit of land at Islip (the site of a demolished cottage) south of the cottage occupied by George Wastie (and which I let to him after purchasing the site from the Ecclesiastical Commissioners) to Herbert Pearce Day, the other son of Thomas James Day, and his heirs etc forever. If George Parsons Day and/or Herbert Pearce Day die in my lifetime, I give the premises which the deceased would have received to my Trustees Upon Trust: To sell it and divide the net proceeds between the children of the deceased who outlive me, at age 21 or (if female) earlier marriage. If there are no such children, to pay the proceeds to the survivor of George Parsons Day and Herbert Pearce Day if he outlives me, otherwise to divide it equally between those of his children who outlive me, at age 21 or (if female) earlier marriage. If both George Parsons Day and Herbert Pearce Day predecease me leaving children living at my death, the proceeds are to be divided amongst them per stirpes. I give my Trustees my interest in the leasehold messuages etc at 4 and 6 Avery Row, both in the occupation of Ernest Scott Bishop, Upon Trust to sell them and divide the proceeds between those of the children of John Andrew Bridgwater who outlive me, and the children of any who predecease me and who reach age 21 or (if female) marry earlier, per stirpes, as tenants in common. (But subject to the proviso below re the share of Frederick Tyrrell Bridgwater). If my residuary estate is insufficient to pay my debts, funeral and testamentary expenses, pecuniary legacies and legacy duties, the insufficiency is to be made good out of the proceeds of sale of 4 and 6 Avery Row before they are divided. I give my freehold field at OXF Barton (now in the occupation of Alfred Dring) to my Trustees Upon Trust to sell it and divide the net proceeds equally between themselves, without any deduction for death duties or expenses (which are to be paid out of my residuary estate), as some recompense for their trouble. All the residue of my real and personal estate I give to my Trustees Upon Trust to [liquidate] and with the proceeds: Pay my debts, funeral and testamentary expenses, legacies and death duties. Divide the residue equally between those of the children of John Andrew Bridgwater who outlive me, and the children of any who predecease me and who reach age 21 or (if female) marry earlier, per stirpes, as tenants in common. (But subject to the proviso below re the share of Frederick Tyrrell Bridgwater). I direct that all moneys whatsoever which would otherwise be payable to Frederick Tyrrell Bridgwater (as a child of my cousin John Andrew Bridgwater) shall instead be paid to his wife Ada Elizabeth Bridgwater for her separate use. If she predeceases me, it is to be held in trust for those of his children who reach age 21 or (if female) marry earlier. I empower my Trustees to invest any moneys forming part of my Trust Estate [long list of acceptable investments] Any gift to any female is to be for her sole use independently of any husband. My Trustees may at discretion raise up to half of the expectant share of any minor, and apply it for his advancement or benefit. My Trustees have full discretion to postpone the liquidation of all or part of my estate, to renew any of my leaseholds, or to raise any premiums by way of mortgage etc if they think fit. I authorise my Trustees to determine [a number of potential legal questions]. I revoke all former wills. This is the last Will and Testament of me Mary Ann Bridgwater of Number 49 Woodstock Road in the City of Oxford Spinster. I appoint my friends Thomas Frederick Hawkins of Number 14 Warnborough Road in the City of Oxford Gentleman and Francis Williams of Number 40 Clarence Road Saint Albans in the County of Herts Gentleman Executors and Trustees of this my Will and they and the survivor of them and the executors and administrators of such survivor or other the Trustees or Trustee for the time being thereof are hereinafter called my Trustees or Trustee I bequeath the following pecuniary legacies To my friend Annie Penny the Wife of James Penny of Number 23 Saint John’s Road in the said City of Oxford the sum of Ten pounds (free of legacy duty) To Frank Hudson Jenkins of Little Clarendon Street in the said City of Oxford Greengrocer the sum of Three pounds (free of legacy duty) To Louisa Kate Jenkins Daughter of George Jenkins Greengrocer of Number 9 Little Clarendon Street in the said City of Oxford the sum of Three pounds (free of legacy duty) To Dorothy Walker Daughter of Charles Bolton of Number 2 Observatory Street in the said city of Oxford the sum of Three pounds (free of legacy duty) To Mary Ann Webb Daughter of the late James Webb Saddler of Church Square Islip in the County of Oxford the sum of Three pounds (free of legacy duty) To Gertrude Mary Cook Wife of Frederick Cook of 14 Farndon Road in the said city of Oxford the sum of Three pounds (free of legacy duty) To Hannah Read Widow of Charles Read Blacksmith of 29 Friars Wharf in the said city of Oxford the sum of Three pounds (free of legacy duty) To the housemaid or underservant in my service at the time of my decease if she shall then have been in my service for six months the sum of Three pounds (free of legacy duty) To Daniel Fawdrey of Number 8 Jericho Street in the said City of Oxford Bath Chair Proprietor the sum of Three pounds (free of legacy duty) And to my housekeeper Martha Letitia Honour if she shall continue in my service to the time of my decease the sum of Four pounds (free of legacy duty) for expenses of mourning Also one Preference Share in the Oxford Gaslight and Coke Company Also two Ordinary Shares in the said Oxford Gaslight And Coke Company also the sum of £100 India Three pound per cent stock part of my stock of Two hundred pounds of the same stock And further the sum of Four hundred pounds New Zealand 3½ per cent Stock (all the above mentioned stocks and shares I leave her free of legacy duty) I bequeath to my Executors (free of legacy duty) all my Furniture Jewellery Pictures and other articles Chattels and effects with the request that they will dispose of the same in accordance with any Memorandum or paper deposited with this my Will or left among my papers at my death but such Memorandum or paper shall not be deemed to form part of my Will or to have any Testamentary Character and the above expression of my wishes as to the disposal of the said articles and effects shall not create any Trust or legal obligation. I bequeath to my Trustee or Trustees my leasehold messuage and premises being Number 5 Avery Row New Bond Street London held under the Corporation of the City of London and in the occupation of Henry Brand and Son Upon trust to permit my Cousin John Andrew Bridgwater to occupy the same or receive the rents and profits thereof during his life he paying a proportionate part of the ground rent and fire insurance premium and all rates and taxes and outgoing payable in respect thereof and observing and performing the covenants contained in the Lease under which the same is held And from and after the death of the said John Andrew Bridgwater Upon trust to sell the same and to divide the produce thereof between such of the children of my said Cousin John Andrew Bridgwater (subject to the proviso hereinafter contained respecting the share of Frederick Tyrrell Bridgwater) and the child of any deceased child as shall be alive at the time of my decease and being male attain the age of twenty one years or being female attain that age or marry And if more than one in equal shares per stirpes as tenants in common I devise my freehold dwelling house and premises called Painswick Cottage situate at Number 232 Banbury Road Summertown Oxford aforesaid in the occupation of William Hicks Unto and to the use of George Parsons Day a Son of my late Cousin Thomas James Day (if he shall be alive at the date of my decease) his heirs and assigns for ever I devise my two Freehold Cottages in Church Square Islip in the County of Oxford in the respective occupations of Ernest Shirley and George Wastie together with the small bit of land at Islip aforesaid (being the site of a cottage sometime since being taken down South of the said Cottage occupied by the said George Wastie (and which I let to him after purchasing the site from the Ecclesiastical Commissioners) Unto and to the use of Herbert Pearce Day the other Son of the said Thomas James Day his heirs and assigns for ever But if the said George Parsons Day and Herbert Pearce Day or either of them shall die in my lifetime then I devise the said premises which they or he so predeceasing me would have taken under the devises hereinbefore contained had they or he survived me Unto and to the use of my Trustee or Trustees their or his heirs and assigns Upon trust to sell the same and divide the net proceeds thereof between the children of the said George Parsons Day and Herbert Pearce Day so predeceasing me who shall survive me and being male attain the age of twenty one years or being female attain that age or marry and if more than one in equal shares but so that if both the said George Parsons Day and Herbert Pearce Day shall predecease me and leave children living at my death the said proceeds shall be divided amongst them per stirpes and not per capita And if there shall be no such children then Upon trust to pay the said proceeds to the survivor of them the said George Parsons Day and Herbert Pearce Day if he shall be living at my decease or if he shall not be then living to divide the same between his children who shall survive me and being male attain the age of twenty one years or being female attain that age or marry and if more than one in equal shares I bequeath to my Trustees or Trustee my interest in the Leasehold Messuages and premises Numbers 4 and 6 Avery Row aforesaid both of which are in the occupation of Ernest Scott Bishop Upon trust to sell the same and divide the produce thereof between such of the children of the said John Andrew Bridgwater (subject to the proviso hereinafter contained as to the share of the said Frederick Tyrrell Bridgwater) and the children of any deceased child as shall be alive at the time of my decease and being male attain the age of twenty one years or being female attain that age or marry and if more than one in equal shares per stirpes as tenants in common Provided that if my residuary estate shall be insufficient for the payment of my debts funerary and testamentary expenses and the pecuniary legacies bequeathed by this my Will and any Codicil hereto which I may hereafter make and the duties payable out of the said residuary estate then the insufficiency shall be made good out of the proceeds of sale of the messuages Numbers 4 and 6 Avery Row aforesaid before the same are divided among the children of John Andrew Bridgwater as directed by this my Will. I devise my freehold field at Barton in the County of Oxford (which is now in the occupation of Alfred Dring) Unto and to the use of my Trustees or Trustee their heirs and assigns Upon trust to sell the same and divide the net produce thereof equally between the said Thomas Frederick Hawkins and Francis Williams without any deduction therefrom for any death or other duties or expenses attending the sale (which said duties or expenses shall be paid out of my residuary estate) as some recompense for the trouble they will have as such Executors and Trustees as aforesaid All the rest residue and remainder of my real and personal estate whatsoever and wheresoever I give devise and bequeath and appoint unto and to the use of my Trustees or Trustee Upon trust to sell and convert the same into money (subject to the power to postpone such sale and conversion hereinafter given) and thereout to pay my debts funeral and testamentary expenses the legacies bequeathed by this my Will and the death duties hereinbefore directed to be paid out my residuary estate and divide the residue of such moneys equally per capita between such of the children of John Andrew Bridgwater (subject to the proviso as to the share of Frederick Tyrrell Bridgwater hereinafter contained) and the children of any deceased child of any of them as shall be living at the time of my decease and being male shall attain the age of twenty one years or being female shall attain that age or marry and if more than one in equal shares such last mentioned children or child of such deceased child as aforesaid taking only between them the share that his or her parent would have taken if living at the time of my decease Provided always and I hereby direct that all moneys whatsoever which but for this present proviso would be payable under any of the trusts of this my Will to Frederick Tyrrell Bridgwater as one of the children of my said Cousin John Andrew Bridgwater shall instead be paid to his Wife Ada Elizabeth Bridgwater for her separate use And if she shall predecease me shall be held in trust for such of the children of the said Frederick Tyrrell Bridgwater as being male shall attain the age of twenty one years or being female shall attain that age or marry. I empower my Trustees or Trustee to invest any moneys forming part of the Trust Estate under this my Will which may at anytime be in their or his hands and require investment in their or his names or name in or upon any of the Public Stock or Funds or Government Securities of the United Kingdom or India or any British Colony or Dependency or any Securities the interest on which is or shall be guaranteed by Parliament or upon Freehold Copyhold Leasehold or Chattel Real Securities in Great Britain but not in Ireland or in Stock of the Bank of England or in or upon the Debentures Debenture Stock or Rent Charge guaranteed or Preference Stock or Shares of any Company Incorporated by Special Act or under any General Act of The Imperial Parliament or the Legislature of any British Colony or Dependency or Royal Charter upon the ordinary capital of which Company dividends at the rate of at least three per cent per annum shall have been paid for at least five years before the time of investment or in or upon the Ordinary Stock or Shares of any such Company a fixed or minimum rate of Interest or Dividend on which is guaranteed by the Government of the United Kingdom or India or any British Colony or Dependency or Foreign Government or in or upon the Stocks Funds Debentures or Securities of any Public Municipal or Local Body or Authority in Great Britain (but not in Ireland) or India with power or discretion to vary or transpose such investments into or for others of any nature hereinbefore authorised I declare that any gift or disposition hereby made in favour of any female shall be for her sole and separate use independently of any husband with whom she may be for the time being under couverture And I further declare that my Trustees or Trustee may at their or his discretion raise any part or parts not exceeding one half of the then expectant presumptive or vested share of any minor under the trusts hereinbefore declared and apply the same for his advancement or benefit I authorize my Trustees or Trustee in their or his uncontrolled discretion to postpone during such period as they shall think fit the sale calling in and conversion of the whole or any part or parts of my estate real or personal or to renew any of my Leaseholds if they shall think it advisable so to do and to raise any premiums thereon by way of mortgage or otherwise as in such uncontrolled discretion they shall think fit Also I authorise my Trustees or Trustee to determine what articles pass under any specific bequest contained in this my Will or any Codicil or Codicils or Memorandum hereto and whether any moneys are to be considered capital or income or whether any expenses outgoings or payments ought to be paid out of capital or income and how valuations are to be made or value determined for the purpose of any case of hotchpot and to apportion blended Trust Funds and to determine all questions or matters of doubt arising in the execution of the trusts of this my Will or any Codicil or Codicils hereto. I herby appoint my Trustees or Trustee to be Trustees or Trustee of this my Will for the purposes of the Settled Land Acts 1882 to 1890 and I declare that a sole Trustee for the time being of this my Will shall be competent to act for all purposes of the said Act including the receipt of capital moneys and of notices pursuant to the said Act. Lastly I herby revoke all former Wills Codicils and other Testamentary dispositions at anytime heretofore made by me.
