Nuncupative will.
"Stonesfield slates" roofed much of the housing in a wide surrounding area, including Oxford Colleges. They are made from a type of Cotswold stone which splits easily into thin slabs. A "slate-maker" would have done that work.
Admon was required because he named no Executor. The clerk appears to have used the wrong bond wording, ie that applicable to intestates.

  • Of my money that remains after my debts are paid, half is to go to William Drinkwater's children and the other half to my brothers and sisters.

We Benjamin Bumpass of Stonesfield, slate-maker [see Note], and William Drinkwater of Gagingwell, husbandman, acknowledge ourselves to be bound to the Lord Bishop of Oxford ... £200 to be paid to the said Lord Bishop or his [Assigns]. To the payment of which .... we bind ourselves, and .... our Heirs, Executors and Administrators.

Condition of this Obligation:
  • the above-bound Benjamin Bumpass, Administrator of the goods etc of John Bumpass of Gagingwell, farmer deceased, must make a full Inventory of all his goods etc.
  • He must exhibit that Inventory into the Registry of the Lord Bishop at or before 30th Nov next [1766].
  • He must Administer all his goods etc which at any time after shall come into his possession.
  • He must make a true and just account of that Administration, at or before 31st May 1767.
  • Any residue of the goods etc, after examination by the Judges of the Court, he must deliver to whomever the Judges tell him.
  • If any last Will and Testament shows up, and the named Executor(s) exhibit it to the Court asking to have it approved, and if he being asked delivers the Letters of Administration into the Court, then this Obligation is void.

John Bumpass his Will by word of Mouth made
and Declared by him about Five of the Clock in
the afternoon on Thursday the Seventeenth Day
of April in the presence of us who have hereunto
Subscribed our Names as Witnesses hereto My
Will is that Ben shall have my House and all
my Cloaths but no part or share of money My
money that is out after my Debts be paid one
halfe shall goe to William Drinkwaters
Children and the other halfe to my Brothers
and Sisters the seven and Forty Shillings which is
due from Maning of Deddington to help towards
Buriing me

Know all Men by these Presents that We Benjamin
Bumpass of Stonesfield in the County of Oxford
Slatmaker And William Drinkwater of Gagingwell
in the County aforesaid Husbandman
are held and firmly bound unto the right rev. Father in
God John by divine permission Lord Bishop of Oxford
in Two hundred pounds
of good and lawfull money of Great Britain, to
be paid to the said right reverend Father or to
his certain Attorney his Executors, Administrators Assignes
To which payment well and truly to be made We oblige ourselves
and each of us by himself for
the whole our and each and every of our Heirs Executors,
and Administrators firmly by these Presents Sealed with our Seals
Dated the twelfth day of May in the
Sixth Year of the Reign of our Sovereign Lord
George the Third by the Grace of God of Great
Britain, France, and Ireland King Defender of the Faith and
so forth And in the Year of our Lord One Thousand Seven
hundred and Sixty Six

The Condition of this Obligation is such, That if the above bounden
Benjamin Bumpass Administrator of all and singular the Goods, Chattels
and Credits of John Bumpass late of Gagingwell aforesaid Farmer Deceased do
make or cause to be made a true and perfect Inventory of all and singular the Goods
Chattels and Credits of the said Deceased which have or shall come to the Hands,
Possession, or Knowledge of him the said Benjamin
or into the Hands and Possession of any other Person or Persons for him and
the same so made do exhibit or cause to be exhibited into the Registry of the Lord
Bishop aforesaid at or before the last Day of November
next ensuing and the same Goods, Chattels and Credits and all other the Goods, Chattels
and Credits of the said Deceased at the time of his Death which at any time after
shall come to the Hands or Possession of the said Benjamin
or into the hands and Possession of any other Person or Persons for him do well and
truly administer according to Law; And further do make or cause to be made a true and
just Accompt of his said Administration at or before the last Day of
May 1767 and all the Rest and Residue of the said Goods, Chattels, and Credits
which shall be found remaining upon the said Administrators Accompt the same being
first examined and allowed by the Judge or Judges for the time being of the said Court
shall deliver and pay unto such Person or Persons respectively as the said Judge or Judges
by his or their Decree or Sentence pursuant to the true Intent and Meaning of a late
Act of Parliament made in the two and twentieth and three and twentieth Years of the
Reign of our late Sovereign Lord King Charles the Second, intitled an Act for the
better settling of Intestates Estates shall limit and appoint; And if it shall hereafter appear
that any last Will and Testament was made by the said Deceased and the Executor or
Executors therein named do exhibit the same into the said Court making Request to have
it allowed and approved accordingly if the said Benjamin Bumpass
above bounden being thereunto required do render and deliver the said Letters of Admi=
nistration (Approbation of such Testament being first had and made) in the said Court;
then this Obligation to be void, or else to remain in full force and virtue.
