Quite a lot of the will is concerned with his determination to prevent his son John from marrying Anne GARDNER.

I William Busby the elder of Over Norton . . . yeoman . . .
  • I . . . will that my body be decently interred according to the discretion of my Executors in a manner befitting the respect due to human nature.
  • I give to my son William Busby, his heirs & assigns for ever, all my Messuage or Tenement and homestall thereunto adjoining and one yard land of arable meadow & pasture ground and three acres of arable and half a common? with all the appurtenances thereunto belonging upon this condition following: that my son William shall well & truly pay or cause to be paid unto my son John Busby the sum of £100 of lawful English money, to be paid unto him within six months next after my son John shall marry and take to wife any other woman excepting Anne Gardner the daughter of Edward Gardner of Over Norton aforesaid, or within six months next after the said Anne Gardner shall be married to any other man excepting my son John.
  • My Will is that if my son William do refuse and will not pay the said sum of £100 of lawful English money to my son John Busby as aforesaid, then I give and devise to my son John Busby his heirs and assigns for ever the moiety or one half part of my Messuage or Tenement and homestall & the moiety or one half part of my yard land & three acres of Land & the moiety or one half part of all the Appurtenances thereunto belonging.
  • My will is that if my son John Busby do marry & take to wife the said Anne Gardner the daughter of Edward Gardner of Over Norton aforesaid that then his legacy of £100 or the [half of all that property] shall be absolutely void and of no effect. Then I give to my son John Busby the sum of £5 of lawful English money and no more.
  • I give to my grandson William Coldicott one ewe and lamb.
  • I give to the Overseers of this my will 2/6 apiece to buy each of them a pair of gloves.
  • All the rest of my goods, cattle chattels and personal Estate undevised I give to my two sons William Busby and John Busby whom I make my whole Executors of this my last Will and Testament. But if my son John Busby do marry and take to wife the said Anne Gardner then my son John Busby shall have nothing to do with the Executorship nor to have any profit thereby.

In the name of God Amen the tenth day of
August in the thirtyeth yeare of the Raigne of out Sover'gne
Lord Charles the Second by the grace of God King over England __?
Annoq' D'ni 1678 I William Busby thelder of Overnorton in [the]
County of Oxon Yeoman being of sound & disposing? memory [do?]
make this my last Will & Testament contayning therein my last Will
& Testam't in manner and forme following ffirst I committ my
selfe to God and his grace in an humble hope of Eternall Life and
I will that my body bee decently interred according to the discretion of
my Executors in a manner bifitting the respects due to humane nature
And as for and concerning my reall & p'sonall Estate I dispose of [in]
manner as followeth Item I give & devise to my Sonne William
Busby his heirs & Assignes for ever All my Messuage or Tenem't and
homestall thereunto adjoyning and one yard Land of arrable Meadow &
pasture ground and three Acres of arrable and halfe a Comon? w'th all
the Apptennces thereunto bilonging upon this Condition following that
(that is to Say) that my Sonne William shall well & truely pay or? cause?
to bee paid unto my Sonne John Busby the Sume of one hundred pounds
of lawfull English money to bee paid unto him w'thin Six Months next
after my Sonne John shall marry and take to wife any othe woman
excepting Anne Gardner the daughter of Edward Gardner of Overnorton
aforesd or w'thin Six Months next after the sd Anne Gardner shall
bee married to any other man excepting my Sonne John
Item my Will is that if my Sonne William doe refuse and will [not?]
pay the said Sume of one hundred pounds of lawfull English [money]
to my Sonne John Busby as aforesd Then I give and devise to
my Sonne John Busby his Heirs and Assignes for ever the moity

Itm my Will is that if my Sonne John Busby doe marry
& take to wife the said Anne Gardner the daughter of Edward

or one halfe pt of my yard Land and three Acres of Land and the moity
or one halfe pt of all Thapp'tennces thereunto belonging shalbee absolutely
voyd and of none effect Then I give and devise to my Sonne John Busby
the Sume of five pounds of lawfull English Money and noe more Itm
I give & devise to my Grandson William Coldicott one Ewe and Lambe
Itm I give & devise to the Overseers of this my Will two shillings and
Six pence a peece to buy each of them a paire of gloves Itm all the rest
of my goods Cattle Chattells and p'sonall Estate undevised I give and
devise to my two Sonns William Busby and John Busby whome I doe
make my whole Executors of this my last Will and Testam't. But if
my Sonne John Busby doe marry and take to wife the sd Anne
Gardner then my Sonne John Busby shall have nothing to doe w'th the
Executorship nor to have any p'fitt thereby I doe intreate my loveing
friends John Smith of Chippingnorton Gent and William Timms the Younger
of Overnorton aforesaid Yeoman to bee the Overseers of this my Will to
see the same p'formed according to the true intent and meaning thereof
