Another of those micro-managers who went into enormous detail about the praying to be done for his soul.
The word "Bargayne" has appeared in other wills and the editor still doesn't know what it meant. Some kind of contract?
Nor does the ed understand the bit about daughter Sybell marrying the under-age Thomas Lymeryke -- some kind of legally enforceable betrothal "bargayne"? The contributor says that they do appear to have married.
It seems possible that daughter Mary POWER is a widow, her son Vincent having become the "ward" of his grandfather and uncle.
The forename Johan seems to represent two males, two females and two legatees who could be either.
With a Johan in each, the ALEN and ALEYN families may be different, not a clerical error.
Legatee Isabell SYDE is described as "my wife's daughter". Wife's second marriage? She is here summarised (and indexed) as "stepdaughter" but users should be aware that this may be wrong.
In one place his wife is named as Elizabeth -- since she is Isabell in a dozen places, this is assumed to have been a clerical error.

  • My body is to be buried in the church of whatever parish or religious house where I happen to be at my death.
  • I give 12d to the church of Lincoln.
  • I give 6s 8d to the rood light of Waterperry church and 3s 4d to the maintenance of other lights in the church.
  • I give 40s to the four orders of friars (10s each) in Oxford for my Trentals to be done for my soul and my friends' souls.
  • My wife Isabell and son Richard are to have all such work done as is necessary for the removal, repair and replacement of the lead and tiles of the roof of Waterperry church (at their discretion), and my Executor is to refund the cost.
  • My wife Isabell and son Richard are to give 10s pa to the Prior of the Augustine Friars in Oxford to pray for the souls of myself, my wife, my father and mother and all my kinsfolk, three collects [defined in the full Transcript] to be said every day at high mass.
    The Prior is to spend 3s 4d of the 10s on an annual repast for the brothers and 6s 8d for the support of the house of Augustines.
    If the memorial prayers and collects are not said as above, my wife and son are to give the money to the house of the Black Friars in Oxford for the same purpose.
  • My wife and my son Richard are to cause an honest priest to sing for me and my friends from immediately after my decease for one whole year, and my Executor is to refund the cost.
  • Re my lands, tenements and rents in Buckinghamshire:
    • After my decease all my feoffees who now hold them are to do so to the intent that all those lands, tenements, rents and profits are be for the sole use of my wife Isabell for life.
    • After my wife's decease my son Richard and his heirs forever are to have:
      • My manor of Carbonell in BKM Addington with all my lands, tenements, rents, reversions and services, woods, meadows, pastures, feedings etc in Addington.
      • All my messuages, lands, tenements, rents, reversions, services, woods, meadows, pastures, feedings etc in BKM Bledlow, Risborough, Saunderton, Longwick, Alscott and Kingsey and their parishes or in any other hamlet which I bought from Edmonde Norres called Fraselles[?] and Old Castelles[?].
    • After my wife's decease all my other lands, tenements, rents, reversions etc which I have in BKM and YKS go to my son Thomas and his heirs for ever.
      Except one piece of land called the Gilden Milles in OXF, whose occupants are to pay the above 10s pa for me to be prayed for forever.
  • My son Gregory is to have the whole bargayne of the wardship and marriage of Vincent Power wherein he is joint bargaynor with myself (see Note).
  • Whereas today I delivered to Richard Curson my pasture and feeding at Bychendon [?] with 500 sheep and 20 kine on it, to occupy it and take the profits.
    After my decease he is to deliver the 500 sheep and 20 kine to my wife Elizabeth (see Note), or sheep and kine to the same value as those have today.
  • I give all my household stuff at Waterperry and Waterstock to my wife Isabell to dispose at her pleasure.
  • I give the rest of my goods and cattle to my Executor for the following purposes:
    • To pay my debts and burial expenses.
    • To pay the wages for a priest to sing for me and my friends for one year, as above.
    • To perform the further legacies below.
    • To take 5 marks for his labour.
    • To divide the residue between my children, by the oversight of my wife Isabell and my son Richard.
  • Whereas my wife and I have deeded our lands etc called the Gilden Milles in the Lordship of Cogges to our eldest son Richard Curson and the heirs of his body (with remainders as laid down in the deed):
    • Richard and his heirs, and anyone else who by virtue of the deed has interest and possession in the property, are to pay a further 10s pa (besides the above 10s pa) to be given yearly for ever on my anniversary as follows:
      • 5s to be given to certain priests, friars of the house of Augustines, for a yearly trentall of masses on my anniversary in the honour of god and for the health of the souls of myself, my wife Isabell, my father and mother and all Christian souls.
      • The other 5s to be given to such poor people as shall happen to be present way at the anniversary.
      • If any of the heirs of my children who later have an interest in the Gilden Milles are under-age, so that the annual 20s payment cannot be made by them, and if upon the request of the Prior of the friars Augustines to whomever has the control of the property on behalf of the under-age heir for the 20s to be paid, if the guardian or governor of the property does not pay the 20s, then the next heir in remainder after the request and non-payment is to enter in to the Gilden Milles and lands etc and have them forever on the same terms.
    • Considering that my wife Isabell and I have a joint estate in the Gilden Milles etc of our joint purchase, I am unwilling that she should in any way be restrained if she needs to sell or mortgage the Milles for her succour, or if she wishes to put the Milles to any other use, she may do so.
      If she changes the use of the Milles so that Richard or his heirs etc cannot take the rent for the above purposes, then all my feoffees of my lands, tenements, rents etc in BKM Brill [are to be responsible for the payments] and Richard and his heirs etc are to have the surplus arising from the lands in Brill for his costs and pains for [arranging it]
  • My wife Isabell is to have the custody, issues and profits of all the lands, tenements etc of Thomas Lymeryke which I now have in my possession by reason of my wardship of him until he reaches 21; also the wardship and custody of Thomas himself until then.
    If my daughter Sybell at any time between now and Thomas reaching age 21 wishes to marry him, then Thomas is to marry her or else abide such pain as the law will enforce (see Note).
    If Sibell will not marry him within his minority then Thomas Lymeryke is at liberty to marry whomever he wishes without penalty.
  • I make the following bequests:
    • To my daughters Mary Power and Anne Belson 20 lambs each.
    • To William Belson 60 ewes which he has had in his custody for the last two years.
    • To Vincent Power and Anne, son and daughter of my daughter Mary, each 2 ewes and 2 lambs.
    • To Augustine Belson, son of my daughter Anne and my godson, 10 ewes and 10 lambs.
      To all William Belson's other children, Edwarde, Ambrose, Helen and Margarett Belson, 2 ewes and 2 lambs each.
    • To my goddaughter Johan Aleyn 4 ewes and 4 lambs and to Thomas Aleyn 2 ewes and 2 lambs.
    • To John Alen, Johan Alen, Dorathe Alen and my wife's goddaughter Isabell Alen 2 ewes and 2 lambs each.
    • To my godson Walter Harrys and all my other godchildren one ewe and one lamb each.

    • To my sister's son Johan Whyte 40 lambs and 6 yearling weaning calves, and to his brother Leonarde White one horse colt.
    • To George Wolsey one horse colt.

  • My wife Isabell is to have my lease from Alexander Saymer of his lands in Brill called Wilkoke's lands for life.
    After her decease it goes to my son Thomas.
  • If William Belson and his wife Anne, my daughter, are expelled from the farm where they now dwell in in Brill (and not given another dwelling place) they are to have the occupation of all my lands in Brill and the lands involved in Saymer's lease until they [find somewhere else]. they paying the usual annual rent to whomever it is then due.
  • I give all the timber and woods bought from Humfrey Tirell Esq in the Park and in Ledall (Waterperry parish) to my son Richard.
  • I give one lamb to each of my servants in my employ at my death.
  • I make my well-beloved Henry Alen Sr my Executor.

make by the suffran[n]ce of Allmyghty god my last Will and Testament in maner and forme folowing / ffirst I beque[a]th my soule
unto Allmyghty god his blessed mother saint Mary and to all the holy company of heven my bodie to be buried w[i]thin ye church
of eny suche p[ar]isshe or other religiouse house Where I shall fortune to be at in the houre of my dep[ar]ting or de[a]th Also I will & gyve
to the Church of Lincoln xijd Also I woll to be gyven to the rode light of Waterpury church vjs viijd And to the helpe and
maynten'nce of other lightes w[i]thin the same church iijs iiijd Also I woll and gyve to the iiij orders of ffreers in Oxforde for my

to be charged w'th the doying thereof shall bestowe the sayed monney in the house of the Blake ffreers in Oxforde the sayed
prayers and colettes there to be doon for the sayed monney in maner and forme aforesayed Also I woll Isabell my wife and
Richard my sonne do cawse one honest preste to sing for me and my ffrendes immediatly after my decease and to continewe so by
the space of one hole yere And moreov[er] as to the disposition of all my landes Ten[emen]tes and rentes the which I have w[i]thin the shere
of Buckes I woll that all my feoffees that nowe stonde and be seased of the same shall Immediatly after my decease stonde and be

prestes freers of the sayed howse of Augustyns for a trentall of masses yerely the day of myne aniversary to be sayed and
done in the honoure of god and for the helthe the soules of me and Isabell my wife my ffather & motheres soules and all x'pen
soules And the other vs residue to be gyven aswell by the saied Richarde and his heyres as by suche other p[er]sons as shall
have the interest and possession of the saied Londes of the saied Gilden milles to suche poore people as shall happen to be in the
way at the saied aniversary as shall yerely happen to be bestowed And if it happen that any of the heyres of my sayed
Children that here after shall have interest in the sayed londes of gilden milles be w[i]thin age so that the doying of this anuell
payment of xxs cannot by them be well doen after the entent of this my last will than I woll that apon a request made
by the prior of the saied ffreeres Augustyns for the tyme being to suche p[er]sons as shall have the governance of the saied Londes
to thuse of the sayed heyre w[i]thin age for the saied xxs to be paied and doen as above is lymited yf the saied gardeyn

or governor of the sayed londes do not paye the sayed some of xxs as abovesayed that then the next heyre in remayndre after the saied
request made and none payment of the saied xxs shall enter in to all the sayed gilden milles and Londes w'th thapp[ur]ten[a]nces to have to
them for evermore after the forme of the gift aforesaied And furthermore considering that we the saied Walter and Isabell my wyfe
have a ioynt estate of and in the saied gilden milles and other the premisses thereunto nowe lying as of o[u]r ioynt p[ur]chace And not
willing that my saied wife shuld in eny wise in her conscience or by eny maner of meane be restrayned or enervyd of or frome
her libertie If it fortune my saied wife hereafter to have nede to aliene the same milles for her socor or that she be mynded to
put the same milles to eny other use I will that she thereunto in eny wise be not escaped but at her libertie And if it fortune
that my saied wife do chaunge the use of the same milles which is before rehersed that they be put unto Soo that the sayed
Richard or his heyres of his bodie laufully begotten or eny other suche p[er]sonne or p[er]sonnes in the remaynder as shall have interest
to kepe the same aniv[er]sary may not take the rent of the same milles to thuse and entent before declared Than I woll that all
suche feoffees as nowe be seased of and in all those londes ten[emen]tes rentes and hereditamentes whatsoever they be that I have in Brehill
in the countie of Buckes shall stonde seased to thuse of the sayed Richard and of the heyres of his bodie com[m]yng and for lacke of
suche Issue to thuse of all suche as shall be in the remaynders successively as by the same dede of feoffement playnly apperith
to like use and intent as the same Richard of the same gilden mylles stondes now enfeoffed And I will also that the sayed Richard
or his heyres or eny suche as shall be successively in the remaynder shall have the overplus that shall ryse of and uppon the
same londes in Brehill besydes the same xxs for his costes and payne for doying and orderyng of the same xxs at the sayed
aniversary in maner and forme afore lymited Also I wyll that myn Executor doo pay unto Isabell my wife and Richard my
sonne all suche sommes of monney as shall be bestowed on the Workemanshipp of the covering of the church of Waterpury
as it is before lymyted to be doen by the same Isabell and Richard Also I wyll that myn Executor do pay unto the same Isabell
and Richard as moche monney as shall be thought convenie[n]t to fynde a preste to sing for my soule by the space of one hole yere
after my decease that they therew'th doo fynde a preste as I have before willed Also I will that Isabell my wyfe have the
