  • I give my wife Catherine the Executors' Year in my Copyhold Estates in Deddington, and £200 to be paid within three months after my decease.
  • All my messuages, farms, closes, lands, tenements and hereditaments, freehold and leasehold, and all my household goods and furniture, plate, linen, china, books, horses, debts, monies, original mortgages, bonds, notes and securities for money, and all the residue of my real and personal estate and effects I give to my dear wife Catherine and my friend Joseph Rose of Aylesbury, gentleman, and their heirs etc; In Trust that they shall [liquidate everything] and out of the proceeds:
    • Pay all my debts, funeral and testamentary expenses, all the expenses of [selling], and the above £200 to my wife.
    • Divide the residue equally between my wife and my six children Samuel, Mary, Catherine, Francis, Jane and Edward.
  • I appoint my wife and Joseph Rose Executrix and Executor.
  • I give my Trustees discretion to [deal with] or submit to arbitration any account, debt etc owing to me upon any account(s) between me and my partner Mr Samuel Churchill or anyone else.

This is the last Will and Testament of me Samuel Churchill Field of Deddington in the County of Oxford Gentleman I give unto my wife Catherine the Deeds Year or Executors Year in my Copyhold Estates in Deddington and the legacy or sum of two hundred pounds to be paid within three months after my decease And as to for and concerning all and every my messuages farms closes lands tenements and hereditaments as well freehold as leasehold and also all and every my household Goods and ffurniture plate linen china books horses debts monies original mortgages bonds notes and securities for money and all other the Rest Residue and Remainder of my real and personal Estate and Effects whatsoever and wheresoever and of what nature kind or quality soever the same may be at my decease I give devise and bequeath the same and every of them and every part thereof and all my estate and interest therein respectively unto my said deere wife Catherine and my friend Joseph Rose of Aylesbury Gentleman their heirs executors administrators and assigns To hold the same unto and to the use of them my said wife and the said Joseph Rose their heirs executors admors and assigns according to the different natures and quality of the same estates respectively after the trusts and for the intents and purposes hereinafter mentioned expressed and assigned of and concerning the same (that is to say) upon trust that they said wife and the said Joseph Rose or the survivor of them of the heirs executors or administrators of such survivor do and shall with all convenient speed after my decease make sale and absolutely dispose of all and singular my said freehold and leasehold Estates and Premises hereinbefore devised either together or in parcels and by public auction or private contracts for the most money and best price or prices that at the time of such sale or sales can be reasonably obtained or gotten for the same and do and shall in like manner make sell and absolutely dispose of all such part or parts of my said personal estate and effects hereinbefore bequeathed to them as shall not consist of monies or securities for money and shall convert get in and receive all such part and parts thereof as shall consist of monies and securities for money and do and shall with and out of the monies to arise and be produced by such sale & and to be collected got in and received as aforesaid in the first place pay satisfy and discharge all my just debts funeral and testamentary Expences and all the costs charges and expences of preparing for making and compleating such sale or sales as aforesaid and the said legacy of two hundred pounds to my said wife and do and shall stand and be possessed and interested of and in the residue of the monies to arise and be produced from the respective sales of my said personal Estate and Effects as aforesaid and to be collected got in and received as aforesaid In trust for my said dear wife and my six Children Samuel Mary Catherine Francis Jane and Edward equally to be parted and divided between my said Wife and Children share and share alike To whom I give the same accordingly And I do hereby nominate constitute and appoint my said wife and the said Joseph Rose Executrix and Executor of this my Will And I do hereby authorize and empower them my said Trustees and Executors and each of them and the survivor of them and the Executors and Administrators of such survivor to comp…..or compound or submit to arbitration any account debt or debts sum or sums of money that may be owing or appear to be owing to me at the time of my decease upon any account or accounts between me and my partner Mr Samuel Churchill or any other person or persons whomsoever and give or allow and take such fair and reasonable time to take and accept such security or assurance for the payment thereof as my said trustees and Executors in their her or his discretion shall think fit And I do hereby expressly declare and direct that every receipt which shall be given by the trustees or trustee for the time being acting in the Execution of the trusts of this my Will or by either of them to any purchaser or purchasers of all or any part of my real or personal Estate and Effects or to any other person or persons for any money to be received by my said trustees or either of them by virtue of this my Will shall be a legal and conclusive discharge to such purchaser or purchasers or other person or persons for any money to be received by my said trustees for so much money as in every or any such receipt shall be acknowledged or expressed to be received and shall fully and for ever release and exonerate such purchaser or purchasers and other person or persons from all obligation of seeing to the application thereof and from all lien and liability by reason of the misapplication or nonapplication thereof or of any part thereof And I give devise and bequeath unto my said wife and the said Joseph Rose their heirs executors or administrators all such messuages lands and tenements as are now or as to my leasehold hereditaments as at the time of my decease shall be vested in me in trust for any person or persons or by way of any mortgage To hold the same unto and to the use of my said wife and the said Joseph Rose their heirs executors or administrators according to the different natures and qualities thereof for all my estate term and interest To the intent that my said Trustees or Trustee may make conveyances & assignments of such trust estates according to the trusts affecting the same and may be better enabled to get in receive and discharge the money received by any such mortgage or mortgages And I do hereby further declare my will to be that they my said trustees and Executors or either of them or either of their heirs executors or administrators shall not be charged or chargeable with or accountable for any more of the aforesaid trust estates monies and premises than they respectively shall actually receive or shall come to their respective hands by virtue of this my Will nor with or for any loss which shall happen to the same or any part thereof so as such loss happen without their respective wilfull default nor either of them for the other of them or for the acts deeds receipts disbursements or defaults of the other or others of them but each of them only for his or her owns acts deeds receipts disbursements or wilful defaults And also that it shall and may be lawful for them my said Trustees and Executors and each of them their and each of their heirs exors and administrators in the first place by and out of the aforesaid respective trusts estates monies and premises to deduct and reimburse themselves respectively and also to pay and allow to each other all such loss costs charges and expences as they or either of them shall respectively sustain expend disburse or be put unto by reason of the said several trusts hereby in them reposed in relation to the same respectively or the management or execution thereof or any other thing in any wise relating thereunto In Witness whereof I the said Samuel Churchill Field have to this my last Will and Testament contained in three sheets of Paper set my hand and seal this thirteenth day of July in the year of our Lord one thousand eight hundred and twenty five Saml C Field
