Buried 4 Aug 1697 Kingham.
The original will has damage to part of the probate note and the register copy has no probate for comparison.
The date of Probate (and probably also Exhibition) could be 10 Mar or 10 May 1698. But if it were the 10 March following her August death it would be given as 1697 (Julian calendar), so it is either May 1698 or Mar 1698/69. The editor bets on May.
Note that the sequence of money bequests (retained in the Translation though not in the Summary) may imply sibling-hood between married women and the preceding males.
There appear to be two Nehemiah NORGROVEs, but which of them is dead is anyone's guess.
An Inventory is included, but its entire RHS is missing due to severe damage.
Its date (known to be 6th) is assumed to have been in August soon after her burial, as would be usual.

  • I give all my lands, tenements etc in GLS Mickleton to my cousin Richard Hacker of Kingham, gent, and John Norgrove of Chipping Norton, tanner, and their heirs etc for ever, Upon Trust as follows:
    • If my cousin John Hacker of Glympton, clerk, wishes to buy [the property] for £1300, my trustees [are to sell it to him].
      If he refuses to buy it at that price within a year after my decease they are to sell it within the next six months for the best price obtainable.
    • They are to dispose of the £1300 or other proceeds of the sale, plus the rents etc from my death until the sale, first to pay my debts, then to pay as much of the legacies below as possible with the available residue.
      Any legacies then unpaid are to be paid by my Executor.
  • I give my close etc in Churchill known as the Corn Leasow to the above John Hacker, clerk, and George Hacker of Churchill, gent, and their heirs etc Upon Trust as follows:
    • To let [the property] after my decease until John and/or Edward Hacker, sons of John Hacker of Charlbury, mercer deceased, reaches age 21.
    • In the meantime to lay out the rents etc for their maintenance and education and to place them out as apprentices.
    • After either John or Edward Hacker reaches 21 [it seems as if she can't remember which is the elder] ...
      • If within one month [the above] Richard Hacker pays £150 to the 21-year-old and gives adequate security (as approved by my trustees) for the payment of another £150 to the other at age 21, then on the request and at the expense of Richard Hacker my trustees are to convey [the property] to him and his heirs etc forever.
      • If Richard Hacker refuses to pay, or dies before either John or Edward reaches 21, my trustees are to dispose of [the Corn Leasow], by sale or otherwise, for the equal benefit of John and Edward, or for the survivor of either dies before 21.
      • If both John and Edward Hacker die before 21, £120 of the proceeds of the sale of [the Corn Leasow] is to be divided equally between their three sisters Mary, Katherin and Elizabeth, and the residue paid to the above George Hacker.
  • I give the 2⅛ yard lands etc in Churchill now in my own possession to the above John Hacker, clerk, and Richard Hacker for a 99-year term Upon Trust as follows:
    • My trustees are to raise the following sums from the rents etc and pay them (at the present dwelling house of Thomas Hacker in Churchill, by equal portions at Michaelmas and Lady Day beginning on the first such day after my decease) as follows:
      • £6 pa to William Hacker of the City of Oxford, gent, for life.
      • £6 pa to Thomas Marshall of Little Tew for life.
      • £6 pa to Thomas Hacker of Churchill, yeoman, for life.
        But if Mary Hacker, widow, mother of Thomas, pre-deceases him, his £6 pa is to be divided equally between his then-living children.
    • If George Hacker will pay the above [annuities] as directed, my trustees are to permit him and his heirs etc to hold and enjoy [the land etc] and take the profits for his own benefit during the 99 years.
      But if he defaults in all or part of any payment my trustees are to [take over the land etc] and pay the [annuities] out of the rents etc, paying the surplus to him.
    • After the end or earlier determination of the 99 years [ie when all the recipients have died] I give [the land etc] to the above George Hacker and his heirs forever.
  • I give the following sums of money [with the usual provisos to exclude the husbands of married women.]
    • £50 each to Ralph, Nicholas, Francis, John and Stephen Marshall, sons of Ralph Marshall of Little Tew.
    • £50 to Mary Tanner, wife of William Tanner of Wendlebury.
    • £50 to Susanna, wife of Phillip Maule of Bloxham.
    • £50 to Elizabeth, wife of William Huckill of Bloxham.
    • £50 to Anne, wife of Robert Allen of KIngham, and £10 to her husband Robert Allen.
    • £50 each to Elizabeth and Mary, daughters of John Hacker of Churchill, deceased, and £10 to Mary Hacker, his widow
    • £10 to Hanna Busby of Chipping Norton, widow.
    • £100 each to the above John Norgrove, Nehemiah Norgrove of Chipping Norton, mercer, and Thomas Norgrove of Oxford University, clerk.
    • £100 to Susanna, wife of William Muston, clerk.
      The money is to be paid into the hands of the above Thomas Norgrove In Trust for her, to be invested for her sole use [excluding her husband]
    • £50 to Ann, wife of Ralph Marshall Sr of Little Tew.
    • £50 to Dorothy Norgrove, widow, relict of Nehemiah Norgrove of Chipping Norton deceased.

In the name of God Amen I Elizabeth Hacker of Kingham in the County of Ox'on spinster being
weak in body butt of sound & p'fect memory praised bee god doe make & ordeine this my last will & Testam't
in manner following first I com'itt my soule to God my Creator hopeing to bee saved through the
merrits of my only savior & Redeemer Jesus Christ And my body to the Earth from whence it came to bee
decently buried by my Executor hereinafter named And as concerning th'estate w'ch itt hath pleased
God to lend me I dispose of itt in manner following Imp'mis I give and bequeath unto my Cousin
Richard Hacker of Kingham in the County of Ox'on Gent and John Norgrove of Chipping Norton in
the s'd County of Ox'on Tanner & to their heires & Assignes for ever All my lands tenem'ts & hereditam'ts
w'th there & every of their appurten'nces situate lying & being in Mickleton in the County of Glouc'
upon sp'iall trust and confidence in them reposed and to the intent & purpose that in case my Cousin
John Hacker of Glympton in the s'd County of Ox'on Clerke shall (after my decease) bee willing and
desirous to buy and p'chase the s'd lands and tenem'ts lying in Mickleton afores'd att the rate and
price of One Thowsand and three hundred pownds, That then the s'd Richard Hacker & John
Norgrove and the survivor of them and the heires of such survivor doe and shall att any time
w'thin twelve months next after my decease upon paim't of the sum'e of One Thousand & Three
Hundred pownds of lawfull money of England by the s'd John Hacker unto them the s'd Richard
Hacker and John Norgrove, upon the request and att the costs and charges of the s'd John Hacker
by good and sufficient Conveyance and Assurance in the law and such as Counsell learned in the
law shall reasonably devise or advise, convey and assure the s'd lands & tenem'ts in Mickleton afores'd
unto the s'd John Hacker his heires and Assignes for ever But if the s'd John Hacker shall refuse
deny or neglect to p'chase the s'd lands and tenem'ts att the rate and price afores'd w'thin the space
of twelve months next after my decease That then the s'd Richard Hacker and John Norgrove and
the survivor of them & the heires of such survivor doe and shall w'thin six months next after such
refusall as afores'd or soe soone as conveniently they may make sale & disposall thereof to any other
p'son or p'sons att the best rates and prices the same will yeild or can bee sould for And that they
doe and shall imploy and dispose of the s'd sum'e of Thirteene hundred pownds in case the s'd John
Hacker shall p'chase the s'd lands & tenem'ts as afores'd or of the moneys that shall bee raised by
sale and disposall thereof to any other p'son or p'sons and alsoe of the rents & p'fits that shall bee
made of the s'd Lands & ten'ts from the time of my decease until the same shall bee sould and
disposed of as afores'd in manner following (that is to say) In the first place to pay and satisfy
all such debts & sum'e & sum'es of money as shall bee due or owing by me at the time of my

decease and such and soe many of the legacies hereinafter by me given & bequeathed as the mony
raised by sale of the s'd lands & ten'ts after my debts shall bee satisfied & paid as afores'd shall amount
unto And my will is that such of the s'd legacies hereinafter by me bequeathed as shall not be paid by
sale of the s'd lands & ten'ts as afores'd shall bee satisfied & paid by my Exec'r hereinafter named Item
I give & bequeath unto the s'd John Hacker Clerke & to George Hacker of Churchill in the s'd County
of Ox'on gent & to their heires & Assignes for ev'r All that my close or inclosed ground lying & being
in Churchill afores'd called or knowne by the name of the corne Leasow w'th all p'fits & apurten'nces
thereunto belonging upon sp'iall trust & confidence neverthelesse in them reposed & to the intent
& purpose That they the s'd John Hacker & George Hacker & the survivor of them & the heires of
such survivor doe & shall after my decease demise & let to farme the s'd close or ground w'th the
appurten'nces from the time of my decease untill such time as John Hacker & Edward Hacker
sons of John Hacker late of Charlbury in the s'd County of Ox'on mercer dece'd or one of them
shall attaine to the age of one & twenty yeares for the best yearly rent the same will bring
or can bee sett for And doe & shall imploy and lay out the rents & p'fits of the s'd close or
inclosed ground from time to time untill one of them the s'd John Hacker & Edward Hacker
sons of the s'd John Hacker dec'ed shall attaine to the age of one & twenty yeares for the mainten'nce
& educac'on of the s'd John Hacker & Edward Hacker and to place & set them forth as aprentices
And from and after either of the s'd John Hacker & Edward Hacker sons of the s'd John Hacker
dec'ed shall have attained to the s'd age of twenty & one yeares Then if the s'd Richard Hacker
doe & shall w'thin one month next after either of the s'd John Hacker & Edward Hacker shall
have attained to the s'd age of twenty & one yeares as afores'd well & truly pay or cause to bee
paid unto such of them the s'd John Hacker & Edward Hacker as shall first attaine to the s'd age

And doe & shall alsoe give such sufficient security for the paim't of the sum'e of One hundred &

attained to his s'd age of twenty & one yeares as shall bee liked & approved of by the s'd John
Hacker Clerke & George Hacker & the survivor of them That then the s'd John Hacker Clerke &
George Hacker & the survivor of them & the heires of such survivor doe & shall upon the
request & att the costs & charges of the s'd Richard Hacker by good & sufficient Conveyance &
assurance in the law & such as councell learned in the law shall reasonably devise & advise
convey & assure the s'd close or inclosed ground w'th th'appurten'nces unto the s'd Richard Hacker
his heires & Assignes for ev' But in case the s'd Richard Hacker shall depart this life
before either of the s'd John Hacker & Edward Hacker shall attaine to the s'd age of twenty
& one yeares or if hee the s'd Richard Hacker shall refuse to pay & secure the s'd severall

sums of one hundred & fifty pownds a piece unto & for the s'd John Hacker & Edward
Hacker after either of them shall have attained to the s'd age of twenty & one yeares in
manner afores'd. That then the s'd John Hacker Clerke & George Hacker or the survivor of
them & the heires of such survivors shall dispose of the s'd close or inclosed ground called the
corne leasow for the use & benefit of the s'd John Hacker & Edward Hacker by equall p'portions
if they shall be both living & to y' use & benefit of y' survivor of them in case either of them die before [deletion]
he shall have attained to the s'd age of twenty & one yeares in such manner as they shall thinke most
fit & convenient by sale or otherwise to dispose thereof And my will is that in case both the s'd John
Hacker & Edward Hacker shall die before either of them shall have atained to the s'd age of one &
twenty yeares that then y' sum'e of one hundred & twenty pownds of the money to bee raised by sale
of the s'd close or inclosed ground shall bee equally divided betweene Mary Katherin & Elizabeth
the three sisters of the s'd John & Edward & that the residue thereof shall bee satisfied & paid

Little Tew in the s'd County of Ox'on leavy and raise out of the rents & p'fits of the p'mises the like sum'e

Thomas Hacker W'ch s'd severall sum'e of six pownds my will is shall bee satisfied & paid yearly

& every yeare unto the s'd Wm Hacker Thomas Marshall & Thomas Hacker [deletion] respectively on the
feast daies of St Michaell the Arch'ell & th'annunnciac'on of the blessed virgin Mary by equall
paim'ts during their respective lives Att or in the now dwelling howse of the s'd Thomas Hacker
situate in Churchill afores'd the first paim'ts of the s'd severall sum'es to bee made on such of the
s'd feasts as shall happen next after my death But in case Mary Hacker widow mother of the s'd Thomas Hacker shall depart this life
before the s'd Thomas Hacker & the s'd Thomas Hacker shall her survive That then y' s'd Trustees their
Exec'rs & As's doe & shall yearly & every yeare from & after the death of the s'd Mary satisfy & pay
the s'd sum'e of six pownds before menc'oned to bee paiable to the s'd Thomas Hacker unto such child
or children of the s'd Thomas Hacker as shall bee living at the time of the decease of the s'd Mary equally
to bee divided amongst them in case there shall bee more then one such child and paiable on y'
daies times & place before menc'oned for paim't thereof to the s'd Thomas Hacker Neverthelesse my
will is that if the s'd George Hacker his heires or As's doe & shall satisfy & pay the s'd severall
yearly paim'ts of six pownds p' Ann' yearly & ev'y yeare from & after my decease to the severall p'sons
to whom the same are herein before menc'oned to bee satisfied & paid at the daie time & place before
menc'oned for paim't thereof That then y' s'd John hacker & Richard Hacker their Ex'rs As's doe
& shall p'mit & suffer the s'd George Hacker his heires & As's To hold & enioy the s'd twoe yard lands
& halfe quarter of a yard land & receive & take the p'fits thereof to his & their p'pose & benefit for &
during the s'd terme of fower score & nineteene yeares But in case the s'd George Hacker shall faile
& make default in paim't of the s'd severall yearly sum'es or any of them or any part thereof
That then y' said Trustees their Ex's & As's doe & shall enter upon & hold & enioy the s'd lands & p'mises
& out of y' rents & p'fits thereof satisfy & pay the severall yearly paim'ts of six pownds & satisfy &
pay y' overplus that shall bee raised out of the s'd twoe yard lands & halfe quarter of a yard lands
