  • My debts, funeral and testamentary expenses are to be paid out of my residuary estate.
  • I give all my share in the Ashby de la Zouch Canal to Miss Deborah Eliza Neal of MDX Clapham and her heirs etc.
  • I give all the residue of my real and personal estate and effects to the Rev James Thompson BD, Fellow of Lincoln College Oxford, and his heirs etc Upon Trust as follows:
    • [To liquidate] and invest the proceeds in his own name (with power to vary securities).
    • To pay the dividends to my niece Louisa Sarah Cox for life (without anticipation).
    • After her decease to transfer all the trust property to whomever she directs in writing or by her will.
    • In default of such direction, to transfer [it] to her heirs and assigns or next of kin.
    • If she marries, my trustee or his heirs etc are to transfer all the trust property to the trustee(s) of her marriage settlement.
  • I appoint James Thompson and Louisa Sarah Cox as joint Executors.

This is the last Will and Testament of me Elizabeth Hanwell of the City of Oxford Widow made this twelfth day of August in the year of our Lord one thousand eight hundred and forty three I desire that all my debts funeral and testamentary expences may be paid out of my residuary estate hereinafter bequeathed I give to Miss Deborah Eliza Neal of Clapham Middlesex her heirs executors administrators and assigns all that my share in the Ashby de la Zouch Canal and all the Rest and Residue of my Estate and Effects whatsoever and wheresoever and whether real or personal I give devise and bequeath unto the Reverend James Thompson Bachelor in Divinity ffellow of Lincoln College in the University of Oxford his heirs executors administrators and assigns upon trust at his or their discretion to sell and convert into money such of my said estate as shall not consist of money and to invest the same in his name in Government funds or on real securities with power from time to time to alter vary and change such securities for or into others of the like nature as he or they shall think fit and to pay the dividends interest and annual proceeds thereof and every part thereof unto my niece Louisa Sarah Cox or unto such persons as she shall by writing under her hand appoint to receive the same but not by way of sale or anticipation for and during the term of her natural life and after her decease then upon trust to pay assign transfer or convey all the said trust property to such person or persons as she the said Louisa Sarah Cox by any deed in writing or by her Will or Codicil thereto give devise and bequeath the same and in default of any such gift devise or bequest then upon trust to pay assign transfer or convey all the said trust property to the heirs and assigns or to the next of kin of the said Louisa Sarah Cox according to the nature and quality of the said property provided always and my will is that if the said Louisa Sarah Cox shall at any time be married then that the said James Thompson his heirs executors administrators or assigns shall thereupon pay assign transfer or convey all the said trust property unto the trustee or trustees of her marriage settlement upon the trusts thereof and all other the trusts of this my Will shall cease and I appoint the said James Thompson and Louisa Sarah Cox joint Executors of this my Will In Witness whereof I have hereunto subscribed my hand E Hanwell
