  • I confirm the Settlement made at my marriage with my dear wife Vere and the charge made therein for the benefit of our younger children
  • I give my eldest son John Nicoll all my gold and silver plate.

The Rev'd Richard Nicoll DD

This is the last Will and Testament of
me Richard Nicoll of Boddicott in the County of Oxford Doctor in
Divinity ffirst I confirm the Settlement made on and previous to
my marriage with my dear wife Vere and the charge therein made
for the benefit of our younger children And I give and bequeath unto
my eldest son John Nicoll all my gold and silver plate and also all my
household goods linen and implements of household I give the same
to my said wife and son John in equal share Also I give and devise
unto my son Thomas Vere Richard Nicoll his heirs and assigns the
advowson of Cherrington in the County of Warwick Also I give and
bequeath unto my said son John and my said son Thomas Vere
Richard to be equally divided my study of books Also I give and
bequeath unto Thomas Clare Doctor in Divinity of Bilton in the
County of Warwick Charles ffox of Chalcomb? in the County of Northampton
Esquire my brother in law Richard Wykham and William Walford
of Banbury Gentleman the sum of twenty pounds apiece and to my
servants who shall be living with me at the time of my decease one
years wages each over and above what shall be due to them
And as to all the rest and residue of my personal estate and all my
messuages lands tenements and hereditaments in Boddicot aforesaid
Horley and Hornton in the said County of Oxford Littleborough
and Warkworth in the County of Northampton and in the City of London
not settled by me on my said wife or which have come to me
since my marriage and all other my real estate which I have
a power to dispose of I give devise and bequeath the same unto
the said William Walford his heirs ex'ors and adm'ors Upon trust
that he the said William Walford his heirs ex'ors or adm'ors do
and shall sell and dispose of the same or any part thereof and
do and shall by and out of the monies which shall arise
therefrom and by and out of the rents profits of my said
real estate devised to him in the mean time pay all my debts
as well those affecting my said real estates as others it being my
express desire that all my debts shall be fully paid and satisfied
And from and after payment thereof I give and bequeath all such
money that shall remain in the hands of my said trustee his
heirs executors or adm'ors and all such part of my said real Estate
as shall remain unsold for the purposes aforesaid unto my said
sons John and Thomas Vere Richard their heirs Executors and
Adm'ors as tenants in common And I do direct that the receipt
or receipts of my said trustee his heirs ex'ors and adm'ors for the
money for which my said real estate devised to him or any part
thereof shall be sold shall be a sufficient discharge & discharges
to the person or persons paying the same respectively for the money
for which the same shall be so given or for so much thereof as in
such receipt or receipts shall be respectively acknowledged or
expressed to be thereby received and that the person or persons
paying the same respectively and taking such receipt or receipts for
the same as aforesaid shall not afterwards be obliged to see to the
application or be in any wise answerable or accountable for any
loss misapplication or nonapplication of such money or any part
thereof And I do hereby declare that my said trustee his heirs
executors or adm'ors shall not be answerable or accountable for the
loss of any monies which he or they shall place in the hands
of any person or persons for safe custody nor for any loss or damage
which may happen in the Execution of the aforesaid trusts or
in relation thereunto except the same shall happen by or through

through his her or their own wilful neglect or default And also
that my said trustee his heirs Executors Adm'ors and Assigns
shall and may by and out of the monies which shall come to
his or their hands by virtue of the trusts aforesaid retain and
reimburse himself and themselves all such loss costs charges
damages and expences which he or they shall or may suffer
sustain expend disburse be at or be put unto or which shall
or may be to him occasioned for or on Account or by reason or
means of the trusts hereby in him reposed or the management
or execution thereof or otherwise howsoever relating thereto
And lastly I do hereby nominate constitute and appoint my said
wife and son John Executrix and Executor of this my last Will
and Testament hereby revoking all former and other Wills by me
at any time heretofore made and declare this only to be my
last Will and Testament In Testimony whereof I the said
Richard Nicoll the Testator have to this my said last Will and
Testament contained in two sheets of paper to the first sheet thereof
set my hand and to this last sheet thereof my hand and seal
this twenty fifth day of ffebruary One thousand eight hundred

above named Richard Nicoll the Testator as and for his last
Will and Testament in the presence of us who at his request
and in his sight and presence and in the sight and presence of
each other have subscribed our names as Witnesses - Chas Wyatt

Proved at London with a Codicil 25th June 1813 before the
Worshipful Samuel Pearce Parson Doctor of Laws and Surrogate
by the Oath of John Nicoll Esq'r the son and surviving Ex'or to
whom Admon was granted having been first sworn duly to adm'r.

This is a Codicil to be taken as part of the last Will and
Testament of me the Rev'd Richard Nicoll of Bodicott in the County
of Oxford Doctor in Divinity I give and bequeath unto my friend
William Walford of Banbury in the said County of Oxford Gentleman
the sum of One hundred pounds in lieu of the legacy of twenty
pounds given him in and by my last Will and Testament In
Testimony whereof I have hereunto set my hand and seal
this twenty sixth day of September One thousand eight hundred
and ten - Rich'd Nicoll O - Signed sealed published & declared
by the above named Richard Nicoll as and for a Codicil to be
taken as part of his last Will and Testament in the presence of us
who at his request and in his sight and in the presence and
sight of each other have hereunto subscribed our names as Witnesses
J W Golby - Jno Munford - George Kerby
