Samuel Nicholl In the Name of God Amen I Samuel Nicholl Citizen and Goldsmith of London being of sound Mind and Memory do make this my last Will and Testament in manner following (that is to say) I give and bequeath All my Estate and Effects of what Nature or Kind soever the same may consist at the time of my decease unto and amongst my loveing Wife Ann Nicholl and all such children as I shall leave at the time of my decease in the Shares and Proportions and manner following (that is to say) One full and equal third part thereof (the whole into three equal parts to be divided) I give and bequeath unto my said loveing wife Ann Nicholl and to which she is entituled as I am a ffreeman of the City of London One other third part thereof and which I have the Liberty to dispose of I also give and bequeath unto my said loveing Wife Ann Nicholl And as to the remaining third part of my said Estate I give and bequeath the same unto and amongst all and every my children that shall be living at the time of my decease equally to be divided between them share and share alike and paid to them as they shall severally attain to the Age of one and twenty years And in case any of them shall happen to dye before attaining to the Age of one and twenty years That then the part or share parts or shares of him her or them so dying shall be paid to the Survivors or Survivor of them equally share and share alike And in case all my children shall happen to dye under the Age aforesaid I then give and bequeath the aforesaid third part of my said Estate so given and bequeathed unto my said children as aforesaid unto my said loving Wife Ann Nicholl her Executors Administrators and Assigns And Lastly I do hereby revoke all former and other Wills by me at any time made declaring this to be my only and true last Will and Testament And I do make and appoint my said loveing Wife Ann Nicholl sole Executrix of this my said last Will In Witness whereof I the said Samuel Nicholl have to this my last Will and Testament set my Hand and Seal the nineteenth day of July in the year of our Lord One thousand seven hundred and forty nine Sam’l Nicholl Signed sealed published and Declared by the said Samuel Nicholl the Testator as and for his last Will and Testament in the presence of us Benj'n Robinson J Jackson This Will was proved at London the twenty fourth day of November in the year of our Lord one thousand seven hundred and forty nine before the Worshipfull Robert Chapman Doctor of Laws and Surrogate of the right Worshipful John Bettesworth Also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Ann Nicholl Widow the Relict of the deceased and sole Executrix in the said Will named To whom Administration was granted of all and singular the Goods Chattels and Credits of the said deceased being first sworn duly to Administer. |
