James Pears In the Name of God Amen I James Pears of Woodperry House in the Parish of Stanton Saint John in the County of Oxford Gentleman being weak in Body but of sound and disposing mind memory and understanding do make and ordain this my last Will and Testament in manner and form following (that is to say) I give and bequeath unto my dear Wife Elizabeth Pears the Sum of One thousand Pounds to be disposed of as she shall think proper I also give devise and bequeath unto my said Wife and her Assigns for and during the term of her natural Life All that my ffreehold Messuage or Tenement with the Garden Outbuildings and Appurtenances thereunto belonging situate in the parish of Saint Mary Magdalen in the City of Oxford now in the occupation of Mrs Blandy And from and after the decease of my said Wife I give and devise the said freehold premises unto my Son James Pears and his Assigns for and during his natural Life and from and after his decease I give and devise the same premises unto my Grandson James Robert Pears his Heirs and Assigns for ever But in case my said Grandson shall happen to die in the life time of my said Son without Issue of his Body lawfully to be begotten then I give and devise the same Premises from and after the decease of my said Son unto my two Grandaughters Elizabeth Wynch Pears and Mary Ann Pears their Heirs and Assigns for ever as Tenants in common and not as joint Tenants I also give and bequeath unto my said Wife and her Assigns for and during the term of her natural Life all my Leasehold Estates and all the rest and residue of my Personal Estate and Effects of what nature or kind soever and his Assigns for and during the term of her natural Life one Annuity or yearly Sum of Two hundred Pounds of lawful Money of Great Britain by equal Quarterly payments on the twenty first day of November the twenty fifth day of March the twenty fourth day of June and the twenty ninth day of September in every year without any deduction or Abatement whatever the first payment thereof to be made on such of the said Days as shall first happen after my decease And I do hereby give and bequeath the said Annuity to my said Son and charge my said Leasehold Estates and the residue of my said personal Estate with the payment thereof accordingly And from and after the decease of my said Wife I give and bequeath my said Leasehold Estates and the residue of my said Personal Estate and Effects hereinbefore given to my said Wife for her Life unto my said Son James Pears his Executors Administrators and Assigns And I do hereby make constitute and appoint my said Wife Elizabeth Pears full and sole Executrix of this my last Will and Testament hereby revoking all former Wills by me made I declare this only to be my last Will and Testament In Witness whereof I have hereunto set my Hand and Seal this twenty seventh day of October in the year of our Lord one thousand eight hundred and three James Pears (O) Signed sealed published and declared by the said James Pears the Testator as and for his last Will and Testament in the presence of us who in his presence and in the presence of each other have subscribed our Names as Witnesses hereto Elizabeth Lay, Edward Hanbury, John Dry This Will was proved at London the twenty sixth day of April in the year of our Lord one thousand eight hundred and four before the Right Honourable Sir William Wynne Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Elizabeth Pears Widow the Relict of the deceased and sole Executrix named in the said Will to whom Administration of all and singular the Goods Chattels and Credits of the said Deceased was granted she having been first sworn by Commission duly to administer | ||||||||||||||||||||||||||||
