Transcriber's and Editor's Notes
The early clause re "Hacklings" and "Hendleys" is clearly written but does not make sense.
He gives all of it to son Richard "Provided [that he] quitt his Mothers Joynture", but goes on "Then ... my said Son William Perry shall have the house and Land ... for ever".
There are two main possibilities.
Either the word "Then" actually means "If he doesn't do so" -- but he says "my said son William" though William has not been previously mentioned.
Or he wrote "William" but meant "Richard".
The editor tends to believe the latter, but users who care should read the Transcript and make up their own minds.
The following details are believed to be true but should not be totally relied upon:

  • I give my messuage and its close bought from William Paviour of Oxford, also another close called Moor Close in Standlake which my father bought from Richard Allen, to my loving wife Mary Perry for life, subject to the payment of £200 to my daughter Ann Perry within two years after my decease.
    The properties are afterwards to be disposed of as she thinks fit.
  • I give my messuage and half yard lands called Hacklings, also a parcel of land, mead and common bought from John Hendley, to my son Richard Perry and his heirs etc forever provided that he quits his mothers jointure.
    Then my will is that my son William Perry and his heirs etc are to have the house and land forever [see Notes]
    But my wife is to enjoy all the lands bought from Hendley for life.
  • I give the following to my son William Perry after my wife's decease:
    • My copyhold estate where I now live.
    • A half yard land and quarter of a yard land and a close called Yates.
    • A barn, garden and rickyard which my father bought from John Quinch.
  • I also give my orchard and butt called Fishers to William and his heirs etc forever.
  • I give 10s to my daughter Sarah.
  • I give my one acre of land and cottage called Cuttlers to my son Thomas Perry and his heirs.
    My Executrix is to put Thomas's life in that estate at her own cost.
  • I give 10s to my daughter Mary.
  • If any of my four children Richard, Thomas, William and Ann should die, I give their shares equally divided amongst the survivors.
  • I give £5 each to my grandson William Mayo and granddaughter Mary Mayo, to be paid at age 21.
  • I give 10s to my daughter Elizabeth.
  • Any of the above legatees who refuse to give my Executrix a proper discharge for their legacies are not to have any benefit from my will.
  • I give all the residue of my real and personal estates (after my debts, legacies and funeral expenses are paid) to my loving wife Mary whom I make Executrix ... revoking all former wills.

In the Name of God Amen the Eleventh day of May in the Year of our Lord one
Thousand Seven Hundred and Twenty Eight I William Perry of Brittenton in the Parish of Standlake
in the County of Oxon Yeoman (though Infirme of Body) yet of sound and perfect mind memory and understanding
(thanks be given to God for the Same) Doe make and Ordain this my Last Will and Testament in manner and form
following (that is to say) ffirst I Bequeath my Soul into the Hands of God my Creator hoping and stedfastly
Believing in and through the Merits of My Blessed Saviour and Redeemer Jesus Christ to have Remission of all my
Sins and to have Eternal Salvation my Body I committ to the Earth to be Decently Interred at the Discretion
of my Executrix hereinafter named and as for touching and Concerning all such Worldly Estate itt shall please
God to Bless me with at my Decease I Give Devise and Dispose thereof as followeth.
Impr'is I give unto my Loving Wife Mary Perry all that my Messuage or Tenement and Close thereunto
belonging which I purchased of William Paviour of Oxford and one other Close called Moor Close which my
father purchased of Richard Allen in Standlake aforesaid To hold to my said Wife for and During her
natural Life and after to be Disposed of as she shall think Convenient Subject nevertheless and Chargeable
with the Payment of the Sum of Two Hundred pounds of Lawfull money of Great Brittain to my Daughter
Ann Perry within two Years next after my Deceasse Item I give and Devise unto my Son Richard Perry
his heirs and Assigns for Ever all that my Messuage or Tenement and Half yard Lands commonly called
Hacklings and a parcell of Land mead and Common which I purchased of John Hendley Provided my Said
Son quitt his Mothers Joynture Then my will is that my said Son William Perry shall have the house
and Land herein before mentioned to him his heirs and Assigns for ever But my true intent and meaning
is that my Said Wife shall enjoy all the Lands that I purchased of Hendley for the term of her natural
life Item I give to my Son William Perry my Coppyhold Estate where I now Live and half Yard Land
and Quarter of a Yard land and a Close called Yates a Barn Garden and Rickyard which my father bought
of John Quinch after the Decease of my Said Wife and also I give unto my Said Son William my Orchard
and Butt called fishers to him his heirs and Assigns for Ever Item I give to my Daughter Sarah Ten
Shillings Item I give to my Son Thomas Perry my one Acre of Land and Cottage commonly called
Cuttlers to him and his heirs and I Do hereby appoint my Executrix hereinafter named to put in my Said
Sons life in the Said Estate at her own Charge Item I Give unto my Daughter Mary ten Shillings
And in Case any of the four Children herein before mentioned shall happen to Dye (Vi'zt) Richard
Thomas William and Ann I give and Devise the portion or portions of him her or them
so Dying equally to be Divided amongst the Survivor or Survivors of them Share and Share alike
Item I give to my Grandson William Mayo and Grandaughter Mary Mayo the sum of five pounds
a piecee to be paid them at their respective ages of one and Twenty Years Item I give unto my
Daughter Elizabeth the Sum of Ten Shillings and my will is that if any of the Legatees herein
abovementioned shall refuse to Give my Executrix a proper and Sufficient Discharge for their
respective Legacys so given by me to them as aforesaid shall not have any benefitt or Advantage
of this my will all the rest and residue of my reall and personal Estates that I Shall Dye possessed
of within the Kingdom of Great Brittain (after my Debts Legacys and ffuneral Expences are paid
and Discharged) I give unto my Loving wife Mary whom I hereby constitute Executrix of this
my Will Revoking hereby all former and other Will and Wills by me at any time heretofore
made In Witness whereof I have to this my last will and Testament set my hand and Seal, the
Day and Year first within Written.
