  • I give my messuage with the outbuildings, yard, garden etc in Deddington and now in my own occupation, and all my other real estate, and my furniture, plate, linen, china, stock in trade, monies and securities for money, goods, chattels and all my personal estate and effects to my friends Thomas Walker of NTH Aynho, carpenter, and John Martin Watson of Aynho, gentleman, and their heirs etc Upon Trust to liquidate [all of it] and out of the proceeds pay my debts, funeral and testamentary expenses, and then to hold the residue In Trust for the sole use and benefit of my dear wife Susannah and her Executors etc.

Surman Charles of Deddington

This is the last Will and Testament of me
Charles Surman of Deddington in the County of Oxford
Shopkeeper I give devise and bequeath All that my Messuage or
Tenement with the Outbuildings Yard Garden and appurtenances to
the same belonging situate and being in Deddington aforesaid
and now in my own Occupation and all other my real Estate
and Furniture plate Linen China Stock in Trade Monies and Securities
for Money Goods Chattels and generally all my personal Estate and
Effects whatsoever and wheresoever and of what nature or kind
soever the same may be unto my friends Thomas Walker of Aynho in
County of Northampton Carpenter and John Martin Watson of
Aynho aforesaid Gentleman To hold the same and every part thereof
with the Appurtenances unto the said Thomas Walker and John Martin
Watson their Heirs Executors and Administrators Upon the Trusts
hereinafter mentioned (that is to say) Upon Trust that they the said
Thomas Walker and John Martin Watson & the Survivor of them and the
Heirs Executors and Administrators of such Survivor do and shall as
soon as conveniently may be after my Decease make sale and absolutely
dispose of my said Messuage or Tenement and other my said real Estate
and also my Household Goods Furniture Plate Linen China Stock in
Trade and such other parts of my said personal Estate and Effects as
shall not consist of Monies Debts or Securities for Money by public Auction
or private contract unto any person or persons who shall be willing to become
the purchaser or purchasers thereof for the most money that at the Time or
respective times of such Sale or Sales can be reasonably had or gotten for
the same and do and shall collect get in and receive all such parts of
my said personal Estate and Effects as shall consist of Monies Debts and
Securities for money so that the whole of my said real and personal Estate
and Effects may be converted into ready Money and by and out of the
Monies which shall arise and be produced from such sale or sales
and be collected got in and received as aforesaid do and shall in
the first place pay satisfy and discharge all my just Debts and my
funeral and testamentary expenses and from and after full payment
and satisfaction thereof and of all such Costs Charges and Expenses
as they my said Trustees or Trustee shall be at or put unto in making such
sale or sales and collecting and getting in such Monies as aforesaid
Then Upon Trust that they the said Thomas Walker and John
Martin Watson and the Survivor of them and the Heirs Executors

and Administrators of such Survivor do and shall stand and be possessed
of and interested in all and every the then rest and residue of the Monies which
shall arise and be produced and received from my said real and
personal Estate and Effects and every part thereof Upon Trust for and
for the sole and proper use and benefit of my dear Wife Susannah her
Executors Administrators and Assigns To whom I do hereby give and
bequeath and direct the same to be paid accordingly and I do hereby expressly
declare and direct that the receipt and receipts of the said Thomas Walker and
John Martin Watson and the Survivor of them his heirs Executors and
Administrators shall be a good and sufficient discharge and good and
sufficient discharges to the purchaser or purchasers of all or any part of my said
real and personal Estate hereinbefore devised and bequeathed In Trust to
be sold for his her or their purchase money or purchase monies and also to
any other person for any monies to be received under the Trusts of this my Will
and that after such receipt or receipts given such purchaser or purchasers or other
person or persons his her or their Heirs Executors or Administrators shall not
be answerable or accountable for his her or their purchase Money or other
monies or any part thereof or for any loss Misapplication or Nonapplication
thereof And I do hereby nominate and appoint the said Thomas Walker and
John Martin Watson Executors of this my last Will and Testament Provided
and I do hereby declare my Will to be that they my said Trustees and Executors
or either of them their or either of their Heirs Executors or Administrators shall not
be charged or chargeable with or accountable for any more of the aforesaid
Trust Monies and premises than they shall actually receive or shall come to
their respective hands by virtue of this my Will nor shall they or either of them
be answerable or Accountable for the other of them nor for the Acts Receipts
Neglects or Defaults of the other of them but each of them for his own Acts
Receipts Neglects and wilful defaults only And also that it shall and may
be lawful for them my said Trustees and Executors and each of them their and
each of their heirs executors and administrators in the first place by and
out of the said Trust Monies and Effects to deduct and reimburse themselves
and himself and to pay or allow to his Cotrustee or Coexecutor all such
Loss Costs charges and expenses as they shall respectively sustain expend
or be put unto by reason or means of the several Trusts hereby in them
reposed in relation to the same Trust Estate or the Management or execution
thereof or any other thing in any wise relating thereto In Witness whereof
I the said Charles Surman the Testator have to this my last Will and Testament
contained in three sheets of paper set my hand and Seal this second day of
October in the year of our Lord one thousand eight hundred and twenty

Declared by the said Charles Surman the Testator as and for his
last Will and Testament in the presence of us who in his presence at
his request and in the presence of each other have subscribed our names
as witnesses thereto Joseph Symoth Ann Porgiter Will'm Last?

This Will was proved at Oxford on the 2nd day of May in the year of our Lord 1821 Before
