This is the last Will and Testament of me George Timms of Brizenorton in the County of Oxford, Stonemason, made this Twentyninth day of March in the year of our Lord one thousand eight hundred and sixty as follows, I give devise and bequeath all and singular my real and personal Estate to my Son Joseph and my Soninlaw William Cosier To hold to them their heirs executors administrators and assigns according to the natures and tenures thereof Upon trust in the first place to pay out of my personal estate all my just debts funeral and testamentary expences then to pay all the rents interest and profits of the said real and remainder of the said personal estate to my Wife during her natural life and permit her to have the use of my household furniture and effects of a like nature during her life and if my Trustees should be of opinion that the rents and interest of my said real and personal estate are not from time to time sufficient for the comfortable support and maintenance either in health or sickness of my said Wife then I direct them to apply any part of the corpus of my said personal estate towards such support and maintenance and also from time to time as such occasion or necessity may arise (of which occasion or necessity I declare that their decision shall be absolute) to sell and absolutely dispose of my real estate or chattels real with the same powers and discretions hereinafter given in case of such Sale after the decease of my said Wife and to apply such portion or portions of the purchase moneys as they shall think necessary in or towards such support and maintenance and upon the decease of my said Wife I direct my said Trustees to convert the whole of my said real and personal Estate or the remainder thereof into money and for the purpose of such conversion of my said real estate I declare that it shall be lawful for them to sell the same either by Public Auction or Private Contract and together or in parcels and to enter into make and execute all necessary contracts acts deeds conveyances and assurances to the purchaser or respective purchasers thereof and stand possessed of the money to arise from such conversion Upon trust to pay share and equally divide the same unto and between all my children I declare that the receipt and receipts of my said Trustees and Executors shall be sufficient discharges to any person or persons paying the same for any money or moneys in such receipt or receipts acknowledged to be received and that such person or persons shall not afterwards be obliged to see to the application thereof or be answerable for the misapplication thereof I appoint my said Trustees joint Executors of this my Will hereby revoking all former and other Wills by me at any time heretofore made In witness whereof I the said George Timms the Testator have to this my last Will and Testament contained in two sheets of paper set my hand the day and year first before written George Timms ------------ Signed by the said Testator as and for his last Will and Testament in the joint presence of us present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our Names as Witnesses ------ Wm Plaster,Bampton, Oxon -------- Isaiah Smith, Brize Norton On the Fourteenth day of December 1863, the Will of George Timms late of Brizenorton in the County of Oxford, Stonemason, deceased, who died on the Sixth day of December 1862, at Brizenorton aforesaid, was proved in the District Registry attached to Her Majesty's Court of Probate at Oxford, by the Oath of Joseph Timms of Brizenorton aforesaid, Stonemason, Son of the Deceased, one of the Executors therein named he having been first sworn duly to administer: Power being reserved of making a like Grant to William Cosier the other Executor named in the said Will Effects under £800, including Leaseholds. Extracted by the Executor in person. It is hereby certified that the foregoing is a correct Copy. Dated this Twenty fourth day of December 1863.
