Probate 29 Jun 1610 London (PCC) ... Matilda relict and Executrix ...
Transcriber's and Editor's Notes
A very, very rich micro-manager -- Hah! Wait till you see his wife's ...
Some of the wording is so involved that the editor is not always sure that he has "translated" it accurately. Users to whom it matters should read the full Transcript (below).
He calls almost everyone "cousin", which doesn't help much. He also has several "brother"s who may or may not be in-laws, either his wife's brothers or his sisters' husbands.
Apparently William STAMPE has an eldest son John, while Tesdall STAMPE has an eldest brother Thomas. Either there are two STAMPE families or (perhaps more likely) it's a mistake.
The wording of the bequest to "the children of my cousin Browne" suggests that Browne's first wife had died but then contradicts the suggestion, and the next bequest suggests that she hadn't :-) Users should examine the full Transcript and make up their own minds.
The following details are believed to be true but should not be totally relied upon:
Testator: Husband of Maude TISDALE (1616 qv).
  Translated and paragraphed.
with some of the standard preamble and "legalese" removed.

... I Thomas Tesdale of Glympton... gentleman ... in health of body ...
  • My body I would willingly have buried in the Chapel of Queens College Oxford.
I wish to have a tomb of some plain black stone [inscribed with] the time and place of my birth, my age and the date of my death.
I also wish similar details to be inscribed for my wife, if she is willing to be laid beside me.
  • I give £200 to my nephew Mr Raph Bennatt, eldest son of Mr Richard Bennatt, £100 to be paid within twelve months after my decease and the rest within two years.
  • I give to each of my nephews Mr Thomas Bennatt and Sir John Bennett, knight, if they out-live me, a standing cup of silver worth £20, double-gilt with a cover, in token of my love and good will.
  • I give £100 to my nephew Mr Edmonde Bennatt, £50 to be paid within twelve months after my decease and the rest within two years.
  • I give £100 to my nephew Dr Walter Bennatt, DD, £50 to be paid within twelve months after my decease and the rest within two years.
If he dies before me the £100 goes equally between my nephew Raphe Bennatt and Edmond Bennatt at the appointed times.
  • I give to each of my nieces M'ris Anne Vawre, M'ris Marget Brickendon and M'ris Elizabeth Peerse (all sisters of Mr Raphe Bennatt) a standing cup of silver worth £20, double-gilt with a cover, in token of my love and good will.
  • I give £10 to my brother Richard Foster, to be spent on clothing and other necessaries for him, for if [my Executrix] commits the money into his own hands he will wastefully and wilfully consume it, not for his own good but to his hurt.
I also give him 20 marks pa for life, 5 marks to be paid within three months after my decease and then 5 marks every three months.
When he dies I desire my Executrix to provide that he be honestly buried, and I give £5 to pay for his funeral and to be given to the poor of the parish where he happens to be buried.
I heartily desire my Executrix to take great care in all matters concerning my brother Foster.
  • I give £100 to my cousin Francis Dringe, £50 to be paid within three months after my decease and the rest within six months.
  • I give £100 to my cousin Jasper Dringe, to be paid within two years after my decease.
  • I give £100 to be equally divided between the children of my cousin Browne (those borne by his first wife, who was the daughter of my cousin Beniamyn Watkins), to be paid to every man-child at age 22 and to every woman-child at age 21, those children who shall be born to both of them before my decease. (See Note)
  • I give to my cousin Ellis his wife, if she outlives me, a standing cup of silver worth £20, double-gilt with a cover, in token of my love and good will.
  • I give £100 to my cousin Dennys Cole, widow, to be paid within twelve months after my decease.
  • I give £100 to my godson Robert Stevenson, son of my cousin Lawrence Stevenson, to be paid at age 22.
  • Re my cousin Anthony Tesdale:
    • I give him the remainder of the £100 debt which I lent to him in 1602.
    • I also give him the rest of the lease of the grounds taken from Mr Moryys of Great Coxwell, to hold [it] with its profits etc from the next Lady Day after my decease for the rest of the term, but on condition that before that Day he gives my Executrix sufficient security to pay the rent and perform all covenants which fall due after that Day.
But my Executrix is to pay half of the half-year's rent due on that Lady Day, and also half of the previous Michaelmas rent if I die between Lady Day and Michaelmas.
    • If I outlive my cousin Anthony, I give the remainder of the £100 and the rest of the lease etc to his widow Margarett and his sons Thomas and Elias Tesdall, to hold [it] with its profits etc from the next Lady Day after my decease, they paying such debts for which they stand bound for their father.
The two sons having been paid such money as is owing to them and having discharged such debts as they are charged to pay for their father, the remainder is to be equally divided between the mother and her two sons.
But my gift is on condition that before the Lady Day after my decease the brothers Thomas and Elias Tesdale enter into £500 bonds to my Executrix, not only to discharge the rents and covenants to which I am bound by the lease, but also to discharge my Executrix of all bonds wherein I stand bound with Elias to Mr Clement Dawbney and Edmunde Pye of London re the debts of my cousin Anthony, their father.
  • I give £50 to Elizabeth Richards, daughter of Edward Richards deceased, to be paid at age 21.
  • I give £100 to Joane Tesdale, youngest daughter of my cousin Anthony Tesdale, to be paid her within twelve months after my decease.
  • Re my cousin Thomas Tesdale, eldest son of my cousin Anthony Tesdale:
    • When he entered Grays Inn I gave him £200.
    • I have since given him my bond to pay him a further £100, which I have paid at £10 pa, paid quarterly.
    • Now I give him another £200, £100 to be paid within twelve months after my decease and the rest within two years.
    • That makes £500 in all, a great portion for one kinsman to give to another.
Yet I fear that the unthankfulness of his nature is such that he will murmur and grudge that I bestow no more upon him.
If he does so, the world I doubt not will account him unworthy to have so great kindness bestowed upon him, yet because he is my kinsman I show myself so to regard him.
  • I give £50 to John Tesdale, eldest son of my cousin Christopher Tesdale, to be paid within two years after my decease.
  • I give £50 each to my kinsmen Beniayn Tesdale, Christofer Tesdale and Josua Tesdale, sons of my cousin Christopher, to be paid at age 22.
  • I give £100 to Elizabeth Tesdale, daughter of Christopher, to be paid at age 21 or earlier marriage
  • I give £50 to Frances Tesdale, daughter of Christofer, to be paid at age 21 or earlier marriage
  • I give to Elizabeth Tesdale, daughter of my cousin Richarde Tesdale deceased, a standing cup of silver worth £20, double-gilt with a cover, to be delivered to her the day before her marriage.
  • I give £200 to Thomas Tesdale, eldest son of my cousin Elias Tesdale, to be paid at age 22.
  • I give £100 to Anthony Tesdale, son of my cousin Elias, to be paid at age 22.
  • I give £200 to my wife's nephew Tesdall Cotes in recompense of his service done to me, to be paid within two years after my decease.
  • I give £200 to my nephew John Stampe, eldest son of my brother William Stampe, to be paid within two years after my decease.
  • I give to my nephew Tymothie Stampe, brother of John, a standing cup of silver worth £20, double-gilt with a cover, in token of my remembrance of him, to be delivered within two years after my decease.
  • I have had in my hands certain money which my servant Katherine Neale delivered to me many years ago.
My Executor is to pay her £50 in consideration of that money and of her long service, to be paid within one year after my decease on condition that she then immediately gives my Executrix a general acquittance.
  • I give £5 each to every maid-servant or woman-servant who serves my wife, either in the house where I dwell at my death or anywhere else where my wife and I employ them in household affairs, and to whom I give yearly wages and meat and drink.
  • I give £60 to my servant Henry Righton, to be paid at £10 half-yearly after my decease until all is paid, on condition that he continues his service diligently, justly and truly during those three years, my Executrix allowing him meat, drink and such other things as he had from me in my lifetime.
  • I give £6 to the poor of Glympton, £2 at the day of my burial and the rest at £1 pa, paid on the Sunday before Easter.
  • I give £30 to the poor of Abingdon, £10 at the day of my burial, paid in St Helen's Church, and the rest at £5 pa, paid on the Sunday before Easter in the same church after Evening prayer.
I desire my cousins Anthony and Christopher Tesdale to see to the [payments] during their lives, and if they die before all the money is given then some of their sons are to see to it.
  • I give £15 to the poor of Woodstock, £5 at the day of my burial and the rest at £2 10s pa, paid on the Sunday before Easter.
  • I give £10 to the poor of Charlbury, 5 marks at the day of my burial and the rest in equal parts over four years, paid on the Sunday before Easter.
  • I give £6 each to the poor of Wootton, Stonesfield, Nether Kiddington and Over Kiddington, to be paid as for Glympton above.
  • I give £30 to the poor of BRK Stanford Dingley near Newbury (where I was born), to be paid as for Abingdon above.
  • I give £2000 to my wife Maude to give to her own kindred as and when she pleases, because I think it fit that she should have the giving of it to her kindred as I have given to mine.
  • I give £5 to every man-servant to whom I give livery cloaks and who is in my service at the time of my decease, either at Glympton or elsewhere, to be paid within one year after my decease.
  • My nephew Tisdall Stampe borrowed £1000 from me three or four years ago, for which I hold four Obligations wherein he and his eldest brother Thomas Stampe stand bound to pay me long ago.
Now I forgive Tesdall Stampe £500 of the debt and give the other £500 to his three brothers and two sisters (if ever he is able to pay it himself).
But his brother Thomas Stampe is not to be sued or molested for the money.
  • I give 6d to every poor man, woman or child who come to my funeral to be relieved.
  • Whereas God has blessed me in my worldly estate with increase of substance I am minded to dedicate a good part of it to his glory and the service of his Church, also to some of my kindred.
I give £5000 to the Rev George Abbott, DD, now Bishop of London, Sir John Bennett, knight, and Henry Airaye, DD, Upon Trust to buy with it some freehold lands, tenements etc that will bring in at least £250 pa net, and to use the annual rents etc as follows:
    • To maintain and support thirteen Scholars in Balliol College in the University of Oxford if they may be conveniently placed there, otherwise in University College if they may be placed there, otherwise in such other College as my trusty friends think fit.
    • Six of the Scholars are perpetually to be of my poorer kindred, the other seven of the poorer sort born in Abingdon and as poor Scholars of my kinsman Mr William Bennett deceased brought up in his School there ...
    • [There are pages of minute detail about the choice of the thirteen Scholars, their maintenance allowances, their duties, their replacement in case of death, failure or acquiring a benefice, extra payments to the College authorities for their trouble, possible building of extra rooms, possible need for an Act of Parliament ... interested users, if any, should read the Transcript below.]
    • The £5000 is to be raised out of my estate and paid to my Trustees before the raising of the above £2000 for my wife to bestow on her kindred.
  • I also give to my Trustees all my glebe lands, tythes, profits etc, once belonging to the Rectory of WAR Ratley and lying in WAR Upton, to the intent that the annual profits etc may be used for the maintenance of an usher in the school of Abingdon.
    • [The property] is to be conveyed to the master and governors of the Hospital of Christ in Abingdon and their successors forever.
    • Whereas by law my wife may have her thirds of the Upton tithes for life, within six months after my decease she is to release all her right of dower in those tithes to my Trustees, and in consideration of her doing so my Trustees shall within six months after my decease grant to her the following:
      • The tithes of the grounds in Upton (held from Mr Parner under a lease granted to me by John Warner deceased) for the rest of the lease, she paying £4 pa to my Trustees by equal payments at Michaelmas and Lady Day.
      • The tithes of the parcel of ground in Upton called Sugers Wells Side and two little meadows belonging to it (held under a lease from George Danvers Esq of Upton) for the rest of the lease, she paying £3 pa to my Trustees by equal payments at Michaelmas and Lady Day.
    • Also so that the glebe lands and tithes may be held without any incumbrance:
      • By an indenture dated 20 Aug 1609 I bought a 2000-year lease of three closes called the Oxe Hayes in Ratley from Richard Murden of WAR Morton, gent,.
      • I then by my indenture of the same date reconveyed [the property] back to Richard Murden and his heirs etc for the whole term, on the following conditions:
        • That he and his heirs etc forever should pay the rent of £11 13s 10d issuing out of the Rectory of Ratley and payable to the Crown, £5 pa payable to the vicar and 7s 6d pa payable to the Archdeacon of Coventry and Lichfield.
        • That they should satisfy to me and my heirs etc any damages and losses sustained by default of payment of the above rent etc.
        • That if they did not do so it should be lawful for me to re-possess the premises; only myself, my executors or administrators being lawfully able to take that advantage
      • Now my will regarding this matter is that only my wife during her life and after her decease the above Bishop and Sir John Bennett are to be my executors, and that the survivor of the Bishop and Sir John are to make some trusty persons who are likely to have respect for Abingdon School to be his executors in that respect, [and so on successively] so that advantage of this condition may be taken when necessary to save harmless the tithes etc from all the above rents and payments.
  • My cousins Christopher Tisdale, John Stamp of Clements Arme[?], his brother my cousin Timothie Stamp and my wife's nephew Tesdale Coates are to have the valuing and appraising of my goods and chattels, for I have given them an estimate of my said goods as I myself conceive them to be worth.
  • I give the residue of my goods and chattels to my beloved wife Maud, whom I make sole Executrix.
  • This will is delivered to my cousin Christopher Tesdale on 31 May 1610, to be kept by him until either I demand it back or he delivers it immediately after my decease to my beloved wife in the presence of my cousin John Stamp.
